1. Acceptance of Terms
By accessing or using the Wildial application, website, features, content or related functionality, you agree to be bound by these Terms of Use (the "Terms").
In these Terms, "Wildial", "we", "us" and "our" mean Wildial Ltd. "Service" means the Wildial application and any related websites, features, content, functions, outputs and services made available by Wildial.
If you do not agree to these Terms, you must not access or use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement and that you are legally capable of entering into these Terms.
We may suspend or close an account if we reasonably believe that a user does not meet the eligibility requirements.
3. Nature of the Service
Wildial is a reflective and exploratory digital service designed to help users record, notice, explore and reflect on their experiences with nature.
The Service may allow users to upload or create content such as images, notes, emotional responses, voice notes, location-linked encounters and other contextual information. The Service may generate visualisations, classifications, insights and other outputs based on that content.
The Service is provided for personal reflection, informational use, product development, research and aggregated insight generation. It is not a medical, therapeutic, diagnostic, professional, environmental, navigation or safety service.
4. AI-Native Functionality
Wildial is an AI-native service. AI and automated analysis are core parts of how the Service operates and are used to process user content, generate reflections, classify or interpret content, support visualisations, identify natural features, and produce insights.
AI-generated outputs may be inaccurate, incomplete, misleading, subjective, out of date, or unsuitable for your situation. Outputs may not reflect objective reality and may be affected by the quality, context or completeness of the information provided.
AI outputs are provided for reflective and informational purposes only. You must not rely on AI outputs as professional advice or as the basis for health, safety, legal, financial, environmental, navigation or other significant decisions.
Some AI-generated outputs may be reviewed and refined by users. Where you choose to refine available AI-generated outputs, Wildial may retain both the original AI-generated output and your refined version. In many user-facing features and subsequent analyses, Wildial will generally give priority to your refinements where appropriate.
5. AI Identification and Real-World Risk
The Service may provide AI-generated outputs relating to species, plants, fungi, animals, wildlife, natural features, environments, places, objects, behaviours, characteristics, properties, cultural context, ecological context, possible uses, or other insights.
You acknowledge and agree that these outputs may be incorrect, incomplete, misleading or unsuitable for real-world action. Wildial does not verify the accuracy of AI-generated identifications, descriptions, behaviours, uses, warnings or other outputs.
The Service is not a substitute for expert identification, professional advice, local knowledge, official guidance, field guides, safety information, or your own judgement.
The Service is not intended for use in situations where inaccurate information could lead to physical harm or safety risks.
You must not rely on the Service for decisions involving consuming, tasting, touching, handling, approaching, disturbing, collecting, using, entering, travelling to, or interacting with any plant, fungus, animal, natural material, place, object, environment or feature.
You must not rely on the Service for toxicity, edibility, medicinal use, allergen risk, wildlife behaviour, legal access, navigation, environmental hazards, weather, terrain, water safety, personal safety, or emergency decisions.
You are solely responsible for independently verifying any information, assessing risks before acting, following applicable laws and guidance, and ensuring that your actions are safe, lawful and appropriate.
6. Outdoor Activity and Personal Responsibility
The Service may be used in connection with outdoor, nature-based or place-based activities. Outdoor environments can involve risks including weather, terrain, water, traffic, animals, plants, fungi, allergens, unstable surfaces, restricted access, poor visibility and other hazards.
You are solely responsible for your own safety and for the safety of anyone accompanying you. You must assess conditions, your abilities, the legality of access, and any relevant risks independently.
Wildial does not provide navigation, emergency support, environmental risk assessment, access advice, hazard warnings, or safety guidance. You use the Service and undertake any related activity entirely at your own risk.
7. User Content
You retain ownership of the content that you upload, submit, record or create within the Service ("User Content"). AI-generated outputs created from your User Content may be stored and used as part of the Service. Ownership of those outputs does not affect your ownership of the underlying User Content, subject to the licence granted below.
By providing User Content, you grant Wildial a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, copy, process, analyse, transform, display, transmit and otherwise use your User Content to operate, provide, maintain, secure, improve and develop the Service.
This licence includes using User Content to generate outputs, insights, visualisations, classifications, derived data, aggregated data, de-identified data, product improvements, research outputs and partner insights, in accordance with our Privacy Policy.
You are responsible for your User Content. You must ensure that you have the rights and permissions needed to provide it to the Service and to grant the licence described in these Terms.
8. Content Restrictions
You must not upload or submit User Content that is unlawful, harmful, abusive, defamatory, misleading, infringing, invasive of privacy, or otherwise inappropriate.
You must not upload personal data about another identifiable person unless you have a lawful basis and any required consent to do so.
You must not upload content that encourages unsafe conduct, unlawful conduct, cruelty to wildlife, trespass, environmental harm, or misuse of natural materials.
We may remove, restrict or disable access to User Content where we reasonably believe it breaches these Terms, creates risk, or may expose Wildial, users, partners or others to harm or liability.
9. Intellectual Property
Except for User Content, all intellectual property rights in the Service, including all associated software, designs, branding, AI prompts, workflows, databases, graphics, text and other content, belong to Wildial or its licensors. These Terms do not grant you any ownership rights in the Service.
10. Aggregated, De-Identified and Research Uses
Wildial may use data in aggregated, de-identified or anonymised forms to understand patterns in how people experience nature, improve the Service, develop features, conduct research and development, create reports, publish findings, and provide insights to partners.
For example, we may produce aggregated insights about how groups of users emotionally experience places, spaces, products, services or natural encounters. These insights may support business partners, land managers, hospitality, travel, real estate, environmental organisations or other partners in understanding and communicating the emotional value of nature.
We do not provide partners with identifiable personal data or identifiable User Content for these aggregated insight purposes unless we have a lawful basis and appropriate user permission to do so.
Where data is described as aggregated, de-identified or anonymised, we take steps to reduce the likelihood that individuals can be identified. However, technical and legal definitions may vary, and this clause should be read together with our Privacy Policy.
11. Acceptable Use
You agree not to misuse the Service. In particular, you must not attempt to access another user’s account or data, interfere with or disrupt the Service, bypass security measures, reverse engineer the Service except where permitted by law, upload malicious code, scrape or harvest data without permission, or use the Service for unlawful purposes.
You must not use the Service in a way that could damage, disable, overburden, impair, or compromise the Service, Wildial’s systems, or the security or experience of other users.
12. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us promptly if you believe your account has been accessed without authorisation or if your credentials have been compromised.
13. Data Availability and Backups
We aim to operate a reliable Service, but we do not guarantee that User Content or outputs will always be available, preserved, recoverable or error-free.
You are responsible for keeping your own copies of any User Content that is important to you. To the extent permitted by law, Wildial is not liable for loss, corruption or unavailability of data.
14. Beta Status, Changes and Availability
The Service may be provided in a beta, trial, prototype or evolving form. Features may be experimental, incomplete, unavailable, changed or removed at any time.
We do not guarantee that the Service will be uninterrupted, secure, error-free, compatible with every device, or available in every location.
To the extent permitted by law, the Service is provided "as is" and "as available" without warranties or representations of any kind, whether express or implied.
15. Paid Features, Subscriptions and Purchases
Wildial may offer paid features, subscriptions, one-off purchases or other paid services. The applicable price, billing period, renewal terms, cancellation process and any refund rights will be presented to you before you complete your purchase, either within the Service or through the relevant app store or payment provider.
If you choose to purchase a paid feature or subscription, additional Subscription and Payment Terms will apply. Those terms will be made available before you complete your purchase and form part of your agreement with Wildial.
Where purchases are made through the Apple App Store, Google Play or another third-party platform, their payment, billing, renewal, cancellation and refund processes may also apply and may take precedence over these Terms where required by the relevant platform.
16. Third-Party Services
The Service relies on third-party providers for hosting, database, authentication, application functionality, AI processing, species identification, email delivery, analytics, payments or other functions.
Your use of certain features may be subject to third-party terms, policies or technical limitations. Wildial is not responsible for third-party services except where required by law.
17. Suspension and Termination
We may suspend, restrict or terminate your access to the Service if we reasonably believe that you have breached these Terms, created risk for Wildial or others, misused the Service, or used the Service unlawfully.
You may stop using the Service at any time. Account closure and data deletion rights are addressed in our Privacy Policy.
18. Limitation of Liability
To the maximum extent permitted by law, Wildial is not liable for indirect, consequential, incidental, special or punitive loss, loss of profit, loss of opportunity, loss of goodwill, loss of data, or loss arising from reliance on AI-generated or other Service outputs.
To the maximum extent permitted by law, Wildial is not liable for harm, loss or damage arising from any action taken or not taken in reliance on species identification, behaviour, use, place-based, object-based, environmental, emotional, reflective or other AI-generated outputs.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
19. Indemnity
Where permitted by law, you agree to indemnify Wildial against losses, claims, damages, liabilities, costs and expenses arising from your breach of these Terms, your misuse of the Service, your User Content, or your infringement of third-party rights.
20. Changes to these Terms
We may update these Terms from time to time. Where changes are material, we will provide reasonable notice, which may include notice within the Service.
If you continue to use the Service after updated Terms take effect, you will be deemed to have accepted the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
21. Governing Law and Jurisdiction
These Terms are governed by the law of Scotland.
The courts of Scotland shall have exclusive jurisdiction to resolve any dispute arising out of or in connection with these Terms or the use of the Service, subject to any mandatory consumer rights that apply in your country of residence.
